Virginia footnote: HB-1 is really and truly dead

When you’re dealing with legislation, it’s important to remember that bills can sometimes have “resurrections”. Parliamentary procedure is complex, and varies enormously from state to state. Legislators have a variety of options for making a bill go away without having to give it a straight yes-or-no vote, and some of those procedures allow bills to be revived months after the fact.

When we reported in February that Virginia’s HB-1 had been defeated, we noted on the Virginia page that the bill could potentially have been brought back to life in 2013. So we’re pleased to note that this appears not to be the case, and that as of tomorrow, HB-1 will be finally dead:

Sen. Steve Martin, chairman of the Senate Education and Health Committee, does not plan to call committee members back to the capitol for a vote on “personhood” legislation before a Nov. 29 deadline to refer it to the full Senate. Proponents of the bill lobbied hard for him to schedule a meeting.
The Senate voted earlier this year to continue the bill into next session, but without action by Martin, R-Chesterfield, the bill is effectively dead.

There’s no official word on whether Del. Marshall will re-file his bill or concentrate on different issues during the 2013 session. However, in the wake of the substantial controversy over HB-1 and the GOP’s losses in the 2012 election, reports indicate that legislators may not be receptive to renewing divisive efforts to pass personhood in the Virginia legislature.
